U.S. permanent residency is an immigration status that grants foreign nationals the right to live and work in the United States permanently. Individuals who achieve lawful permanent residency are issued a green card, also known as a permanent resident card. EB-5 visa applicants become permanent residents after their I-526 petition is approved by USCIS.
However, at this stage, they become conditional two-year permanent residents, not full permanent residents. This status allows them to enter the U.S. and manage their EB-5 investment for two years. Afterward, the investor can apply for full permanent residency by submitting the I-829 petition. Once approved, the investor, their spouse, and unmarried children under 21 can permanently live and work in the U.S. They can also apply for U.S. citizenship after five years of holding their permanent residency.
Rights of Permanent Residents (Green Card Holders)
Permanent residents in the U.S., also known as green card holders, are granted numerous rights. They are allowed to live and work anywhere within the U.S., providing flexibility in choosing a place of residence and employment. As a permanent resident, individuals are protected by federal, state, and local laws. They also have access to one of the world’s best higher education systems and may benefit from lower in-state tuition fees at universities and colleges. Additionally, they have access to high-quality healthcare. Permanent residents can travel internationally, with the ability to return to the U.S. as long as they maintain their residency status. Moreover, they have the right to apply for U.S. citizenship, although this is optional.

Responsibilities of Permanent Residents
In exchange for their rights, permanent residents are also required to fulfill several responsibilities. They must pay all local, state, and federal taxes just like U.S. citizens. This includes filing income tax returns with the U.S. tax authority based on their global income. However, residents from countries that have a tax treaty with the U.S. can receive credits for taxes paid in their home country. Male permanent residents between the ages of 18 and 25 must also register with Selective Service, which makes them eligible for military draft if the U.S. goes to war. Additionally, permanent residents must maintain good moral character and fulfill physical presence requirements to retain their status.
